Terms of Service

Plain terms for a plain promise: we put a voice agent on your phone line, and we both behave.

§ 01 / THE SERVICE

Entyti provides automated voice agents that answer and place telephone calls on behalf of your business — handling enquiries, qualifying leads, booking appointments, and following scripts you approve. The service is provided on a subscription and/or usage-metered basis as agreed in your order form or pilot agreement. We are an early-stage service operating in a pilot-cohort model; features, capacity, and onboarding schedules may change as the platform matures, and we will tell you when they do.

§ 02 / YOUR ACCOUNT

You are responsible for the accuracy of the scripts, contact lists, and business information you provide, and for keeping your account credentials confidential. You confirm you have the right to use any data you upload to the service.

§ 03 / ACCEPTABLE USE

You agree not to use the service to:

  • place unsolicited promotional calls to numbers registered on India's National Do Not Call registry (NDNC/DND), or otherwise breach TRAI regulations including DLT registration and template requirements;
  • send spam, conduct robocall floods, or misrepresent the identity of the caller;
  • collect or process personal data without a lawful basis or required consent;
  • impersonate any person or organisation, or use the service for fraud, harassment, or any unlawful purpose;
  • attempt to reverse-engineer, resell, or benchmark the service without our written consent.

We may suspend or terminate accounts that breach this section. Where the law requires it, you — not Entyti — are the principal entity responsible for telemarketing registrations relating to your campaigns, though we will help you set them up.

§ 04 / FEES & BILLING

Fees are as stated in your order form. Usage-based charges are billed per answered second unless agreed otherwise. Invoices are payable within the period stated on the invoice. We may suspend the service for accounts with overdue undisputed amounts after reasonable notice.

§ 05 / SERVICE LEVELS & DISCLAIMERS

We work hard to keep agents answering in under a second, but the service is provided "as is" during the pilot phase. Telephone networks, carriers, and third-party infrastructure are outside our control. To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law or applicable Indian consumer protection law.

§ 06 / LIABILITY CAP

To the maximum extent permitted by law, each party's total aggregate liability arising out of or in connection with the service is capped at the fees you paid to Entyti in the three (3) months before the event giving rise to the claim. Neither party is liable for indirect or consequential loss, loss of profit, or loss of data, except for liability that cannot lawfully be limited (including fraud or wilful misconduct).

§ 07 / TERMINATION

Either party may terminate with 30 days' written notice, or immediately for material breach that is not cured within 14 days of notice. On termination we will, on request, export and then delete your call recordings and transcripts in line with our Privacy Policy.

§ 08 / GOVERNING LAW

These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria. We operate the service for the Indian market, and you remain responsible for complying with Indian telecom and data-protection law applicable to your campaigns.
